FACTS. - Vina leased a tavern to Pencille, with a covenant that Pencille would insure the tavern equipment. Insurance was obtained listing Vina and Pencille as an insured corporation or partnership, although they were neither. Jefferson and Transwestern were insurers, and Dunn the insurance salesman. In November, 1979, Pencille informed Dunn that the tavern was closing, and Pencille cancelled the insurance. Dunn observed that the tavern was still open during the next month, until it was firebombed. Vinas insurance claim was denied.
